Academic Engagement Terms and Conditions


These Academic Engagement Terms and Conditions form a material part of the License Agreement which references these Academic Engagement Terms and Conditions and supplement (including the replacement of specific terms) the CoStar License Agreement Terms and Conditions. To the extent any provision in these Academic Engagement Terms and Conditions conflicts with any provision in the CoStar License Agreement Terms and Conditions, the provision in these Academic Engagement Terms and Conditions will control.

1. Definitions. Capitalized terms not defined herein shall have the meanings ascribed to them in the CoStar License Agreement Terms and Conditions. As used herein, the following terms shall have the following meanings:

  • Academic Engagement Center: CoStar’s program to support hotel and real estate education, which provides data for academic research and classroom instruction through subscriptions to the Licensed Product, training materials, and educational support to member colleges and universities.
  • Acknowledgement Form: Online subscription request form to be completed by each of Licensee’s Approved Faculty and Approved Students prior to gaining access to the Licensed Product.
  • Agreement: As defined in the CoStar License Agreement Terms and Conditions, together with these Academic Engagement Terms and Conditions that were effective as of the time the parties fully executed the License Agreement.
  • Approved Faculty: Faculty members including teaching and research assistants of the Licensee.
  • Approved Students: Students who are enrolled in either the undergraduate, Masters, or Ph.D. degree program offered by the Licensee.
  • Authorized User: Authorized User shall mean the Approved Faculty and Approved Students who have executed the appropriate Acknowledgement Form and are included on CoStar’s list of Authorized Sites & Users. The number of Authorized Users shall not exceed the number of users set forth in the License Agreement.
  • Licensed Product: The CoStar Product, together with any training materials, PowerPoints, videos, webinar recordings, certifications, reports, data files, and other products expressly included in the definition of “Licensed Product” and provided to a Licensee pursuant to the Agreement.
  • Personal Data: Any records or information relating to an identified or identifiable natural person.

 

2. Section 2 License is replaced with the following:

  • During the term of this Agreement, CoStar hereby grants to Licensee a nonexclusive, nontransferable license to use only those portions of the Licensed Product that are expressly identified in the License Agreement, subject to and in accordance with the terms of this Agreement.
  • The CoStar Product may be used only by Authorized Users and, except as set forth below, only at the site(s) specifically identified on the License Agreement. Authorized Users shall be assigned a unique Passcode that may not be shared with others, and may only access the Licensed Product via their own computer. Authorized Users may not access the Licensed Product from any publicly-accessible or shared computer, including but not limited to computers located in computer labs, computer clusters, or kiosks. Licensee agrees to assume full and complete liability for any improper use of the Licensed Product caused directly or indirectly by any Authorized Users.

 

3. Section 3 Permitted Uses is replaced with the following
Subject to the prohibitions set forth below, during the term of this Agreement, Licensee may, in the ordinary course of business:

  • use the CoStar Product for Licensee’s use in the classroom, for teaching purposes, for coursework, for student projects, and access to limited amounts of data for academic research (involving publishing in an academic journal). Upon written request from Approved Faculty professors and written consent from CoStar, use of additional amounts of data may be permitted for academic research involving publishing in a peer-reviewed academic journal.
  • use the Database in academic reports and/or papers created and/or published by the Authorized User in the ordinary course of Authorized User’s academic research at the Center, provided that such reports/papers (i) are not commercially distributed (non-academic), and (ii) always acknowledge CoStar as the source / include a source notice in the following form: “Source: CoStar Group, Inc.”

 

4. Section 4 Prohibited Uses (b) is modified as follows:

  • use the Licensed Product for any commercial real estate activities, such as performing brokerage, property management, counseling or appraisal services.
  • use while employed in the industry, on an internship, for an actual school development project, for a student-managed fund, for academic research where the university is receiving grant funding, for work related to writing a book or similar publication or a white paper for industry, for anyone outside the university including friends or family, for sharing by anyone else inside the university who does not have a subscription, or that involves any sort of direct or indirect benefit, either financial or otherwise, to the school, professor, or student.

 

5. Personal Data.In the event Licensee provides CoStar with any Personal Data of Approved Faculty or Approved Students, Licensee consents to the processing of such Personal Data by CoStar in order to provide the services. Licensee may access, correct, delete, or restrict the processing of Personal Data by contacting university@costar.com.
