Airbnb is having an increasing impact on the hotel industry. There are over 2m rooms available for booking on Airbnb, which surpasses the 1.1m rooms available at both Marriot and Starwood combined. Hosts of Airbnb now include owners of small hotels and developers, and recently the Airbnb brand was valued at $25.5bn (£20.8bn). David Ryland, Mark Rajbenbach & Michael James, partners of the real estate practice at Paul Hastings explores the regulatory challenges facing the business in the UK.

However there are current and anticipated regulatory changes that could impact on Airbnb’s business model. It is anomalous that the hospitality industry is subject to extensive health and safety legislation including fire compliance, food safety and disability compliance etc., but that these restrictions do not apply to Airbnb properties. It is likely that at least some of these requirements may be extended to these properties.
